There are many new neighborhood developments all across North Texas. The control of the HOA (Home Owners Association) for these neighborhoods remains with the developer until the last lot is sold. This time period is referred to as the "development period". By Texas legislation, HOAs cannot prevent homeowners from installing solar energy devices. However, there is an exception in the legislation that allows the neighborhood developer to block a homeowner from installing solar energy devices if the neighborhood is in the "development period".  While on the surface, this may seem like a relatively short time period, in many cases the "development period" can extend many years, and in some cases decades.

This topic is timely with Toyota moving its North American headquarters to Plano.  Many Toyota employees will be relocating from California to communities across North Texas. Many will be buying homes in new neighborhood developments. With our great Texas sunshine, many will be planning to put solar energy systems on their new homes. It would be unfortunate for these new Texas citizens not to be able to choose to install solar, or at least have the upfront disclosure that they will not be able to have the choice.

We are trying to help find a way to better inform potential home buyers of neighborhood developments that will allow solar energy device installations while in the "development period" by compiling this information using a "crowd sourced" approach and then posting on our website.

We are asking for everyone's help to gather information.  If you live in, or near, a new neighborhood in North Texas, please contact the neighborhood's HOA and ask if this neighborhood is its "development period". If it is, then ask if the developer will allow an individual homeowner the choice to install solar energy devices.  Then provide the data you have collected by entering it into this online form we have created -


Below is a summary of the information we have gathered so far.  If you know of anyone considering the purchase of a new home in North Texas (or anywhere in Texas for that matter), please let them know about this potential of a developer blocking their sun and consumer choice. Make sure they ask up front before signing the contract for the new home.  As more potential buyers start letting developers know that blocking the sun is bad for business, this issue will begin fading away......
